By accessing and using TrySpeak, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using this service.

2. Service Description

TrySpeak provides AI-powered live translation services through a web application. The service includes:

• Real-time speech-to-text transcription
• AI-powered translation between supported languages
• Text-to-speech audio output
• Context-aware assistance

Service Availability: We strive for 99.9% uptime but cannot guarantee uninterrupted access.

3. Account Registration

To use TrySpeak, you must:

• Be at least 16 years old
• Provide accurate and complete registration information
• Maintain the security of your password
• Accept responsibility for all activities under your account

You agree to notify us immediately of any unauthorized access to your account.

4. Payment Terms

4.1 Pricing

Translation services are sold in hourly credit packages:

• 1 hour: £9.99
• 4 hours: £34.99
• 10 hours: £79.99

Prices are subject to change with 30 days notice.

4.2 Payment Processing

Payments are processed securely through Stripe. By making a purchase, you agree to Stripe's Terms of Service.

4.3 Refund Policy

Digital Products: As translation credits are digital goods consumed immediately upon use, refunds are generally not available except in cases of:

• Technical failure preventing service use
• Unauthorized charges
• Service outages exceeding 24 hours

4.4 Credit Expiration

Translation credits do not expire but are non-transferable.

5. Acceptable Use

5.1 Permitted Use

You may use TrySpeak for:

• Personal travel and communication
• Business travel and professional communication
• Educational purposes

5.2 Prohibited Use

You may NOT use TrySpeak for:

• Illegal activities or communication
• Harassment, threats, or abusive language
• Impersonation or fraud
• Automated/bot access or scraping
• Reverse engineering the service
• Reselling or redistributing the service
• Circumventing usage limits or payment systems

6. Translation Accuracy Disclaimer

IMPORTANT: TrySpeak uses AI-powered translation which may contain errors. We do not guarantee:

• 100% accurate translations
• Preservation of nuance or cultural context
• Suitability for legal, medical, or critical communications

You are responsible for verifying important information. Do not rely solely on TrySpeak for:

• Medical diagnoses or treatment
• Legal advice or contracts
• Emergency situations
• Financial transactions

7. Intellectual Property

All content, features, and functionality of TrySpeak are owned by us and protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the service for personal use only.

8. Privacy and Data

Your use of TrySpeak is governed by our Privacy Policy. By using the service, you consent to our data practices as described in the Privacy Policy.

Key Points:

• Audio is processed in real-time and NOT stored
• Translation history is stored for service delivery
• You can request data deletion at any time

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• TrySpeak is provided "AS IS" without warranties of any kind
• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid in the past 12 months
• We are not responsible for third-party services (Google Cloud, Stripe)

10. Service Modifications

We reserve the right to:

• Modify or discontinue features with 30 days notice
• Update pricing with 30 days notice
• Suspend accounts for Terms violations
• Terminate the service (with refunds for unused credits)

11. Account Termination

11.1 By You

You may delete your account at any time through account settings. Unused credits will be forfeited.

11.2 By Us

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent activity
• Abuse or harm the service
• Fail to pay outstanding charges

12. Indemnification

You agree to indemnify and hold harmless TrySpeak from any claims, damages, or expenses arising from:

• Your use of the service
• Your violation of these Terms
• Your violation of any third-party rights

13. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be resolved in the courts of England and Wales.

EU Users: You also retain rights under your local consumer protection laws.

14. Dispute Resolution

Before filing a lawsuit, please contact us at support@tryspeak.app to resolve disputes informally.

If informal resolution fails, disputes will be resolved through binding arbitration, except:

• Small claims court disputes
• Intellectual property claims
• EU consumers retain right to court proceedings

15. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.

16. Changes to Terms
